An indecent assault is an assault by way of physically touching another person or by the threat of physically touching them. This offence can be committed by a man or a woman on a person of the same or opposite sex. The assault must be of a “sexual” character for it to be considered an indecent assault.

For the crime of indecent assault, the victim must suffer some form of assault or attack, although the victim does not have to experience physical contact from the assailant. Gestures or actions that put the victim in a state of fear, for example threatening someone with physical harm if they do not expose themselves, would be considered an indecent assault.

While there is not a specific definition as to what constitutes "indecency", if the sexual integrity of the victim is violated an assault will likely be considered "indecent". When deciding whether an indecent assault has taken place, consideration will be given to:

  • Any contact between the assailant and victim;
  • Which part of the body was touched;
  • The situation in which the contact took place;
  • Any words or gestures that accompanied the touching;
  • Any other circumstances surrounding the contact, e.g. threats made by the assailant.
